'Recover amount later if win': Mumbai HC rejects ILS Law School's plea to cut fees in SPPU order

Bombay High Court on Thursday refused to grant immediate permission to ILS Law School in its case Savitribai Phule Pune University(SPPU) has decided to significantly reduce the “other fees” charged for its three- and five-year LLB courses.The matter is listed on an urgent basis due to the ongoing Common Entrance Test (CET) admission process. ILS has moved the court against SPPU’s letter dated April 30, 2026, fixing “other fees” at Rs 4,340 for the academic year 2026-27, as against the fee charged by the college at Rs 36,790 for the academic year 2025-26.At the hearing, ILS’s attorneys sought protection from the court and requested permission to continue showing during the admission or charge higher fees. The college has also promised to refund the excess amount if its writ petition ultimately fails. However, the bench refused to pass any such order.The court said ILS can inform CET Cell that the university has fixed the “other charges” at Rs 4,340 and its challenge to the decision is still pending. The judge further noted that if the college later prevails, it may seek to recover the additional fees rather than charging students higher fees up front and then refunding them.The dispute stems from allegations that ILS charged “other charges” for maintenance, facilities and other activities without statutory approval. The high court had previously ordered the state higher education department to investigate after a student complained. After the investigation, the state directed the college to refund the alleged excess fees.The ILS Bar Association and the college filed the petition on June 15, arguing that the SPPU’s decision to reduce fees was “arbitrary, unilateral, without any authority” and was taken without giving the institution any opportunity to be heard. The High Court will hear the case again on June 29.
