Actress: Preity Zinta is the latest Bollywood star to be granted interim relief by the Bombay High Court in a case over unauthorized use of his image, which he claims ‘infringes on his personality, publicity and moral rights’.Justice Madhav Jamdar passed the interim order on Wednesday while hearing a case, observing that misuse of such content affects a person’s fundamental rights, as reported by the Bar and Bench.According to the report, Zinta is seeking protection against social media intermediaries and that they be ordered to remove AI-generated deepfakes, morphed images and other content that allegedly violates her personality and right of publicity.The court reminded online intermediaries of their obligation to exercise ‘due diligence’ under the Information Technology Rules governing digital platforms. Justice Jamdar also expressed concern about the role of intermediaries in preventing harmful and unlawful content.The actress, through her representative, solicitor Jai Munim, argued that the ‘deep fake images, AI and superimposed visuals and morphed pictures prima facie violated her moral, publicity and personality rights’. In her plea, Zinta asked the court to prevent ‘named and unnamed websites and people’ from exploiting her image for commercial or personal gain. The petition specifically seeks protection for the use of ‘his name, nickname, photographs, likeness including his distinctive dimpled smile, caricature, voice, mannerisms, persona or other characteristics of his personality in any form’.Zinta also expressed concern that AI-generated content and chatbot-style interactions impersonating her, were being posted online by alleged infringers.His suit further lists domain names in his name that he did not create. It states, “Personality characteristics are an integral/intrinsic part of his personality rights and/or publicity rights, over which the Plaintiff exercises (and should exercise) exclusive control.”While giving relief to the actress in the case, the High Court also stated that in case of any future cases of infringement, Zinta can approach online intermediaries, including Google, Meta and X, who will seek to remove such content.
